Department of Ecology Issues Interim Guidance on “Net Ecological Benefit”

On June 18, 2018, the Washington Department of Ecology issued an Interim Guidance for Determining Net Ecological Benefit, intended to assist local watershed groups with their near-term planning and to guide the mitigation pilot projects authorized under Engrossed Substitute Senate Bill (ESSB) 6091.  In an article published in Western Water Law & Policy Reporter, Sarah Mack discusses the challenges inherent in Ecology’s definition of “net ecological benefits” for water resource mitigation.
